Overview of the UK Skilled Worker Visa

The UK Skilled Worker Visa is designed for international professionals with the necessary skills to work in the United Kingdom under licensed UK employers. It replaces the Tier 2 visa, introduced at the end of 2020. This visa is available to individuals with qualifications at RQF Level 3 (equivalent to A-level in the UK) or higher, in eligible occupations.

This long-term work visa is initially granted for up to five years, depending on the duration specified in your Certificate of Sponsorship. The visa remains valid only as long as you stay in the same role with your sponsoring employer. If you wish to change roles or employers, you must submit a new application for a Skilled Worker visa.

You can extend your visa before it expires. After five years, you can apply for Indefinite Leave to Remain (ILR) and, one year later, pursue British citizenship. To apply for the UK Skilled Worker Visa, you need a job offer and must meet the eligibility criteria outlined below.

Differences Between Skilled Worker Visa and Tier 2 Work Visa

Distinguishing Factors:

  1. Lowered Skill Level Requirement: The skill level has been reduced from RQF level 6 to RQF level 3, expanding eligible occupations.
  2. Reduced Minimum Salary: The minimum salary requirement has been lowered from £30,000 to £26,200, with further flexibility in specific situations.
  3. Inclusion of New Market Entrants: Recent graduates can now access the Skilled Worker route.
  4. No Visa Cap: There is no numerical cap on Skilled Worker visas.
  5. Exemption from Resident Labour Market Test (RLMT): No RLMT is required, streamlining recruitment.
  6. Elimination of Cooling-off Period: The previous one-year waiting period for reapplication has been abolished.

These changes make the Skilled Worker Visa more attractive and efficient than the Tier 2 (General) work visa.

Eligibility Criteria and Requirements

Eligibility Criteria:

  1. Job Offer from a UK Employer: Secure a job offer from a licensed UK employer.
  2. Employer Approval: Your employer must be an approved sponsor by the Home Office.
  3. Certificate of Sponsorship: A valid “Certificate of Sponsorship” must be issued by your employer.
  4. Eligible Occupation: Your role must be listed under eligible occupations.
  5. Skill Level Requirement: Meet the skill level requirement, minimum equivalent to RQF level 3.
  6. Minimum Salary Requirements: The annual salary must be at least £26,200.
  7. English Language Proficiency: Fulfill the English language requirements.
  8. Financial Capability: Have £1,270 in your bank account to support yourself in the UK.

Job Offer from a UK Employer:

To apply for a Skilled Worker visa, you need a valid job offer from a licensed UK employer. This offer must come from an A-rated business listed as a licensed sponsor, match a role listed under eligible occupations, and meet the minimum salary requirements. A valid Certificate of Sponsorship from your UK employer is also required.

Employer Approval:

Your job offer must come from a company on the Home Office’s list of licensed sponsors. Ensure your employer has the necessary license to hire international workers under the Skilled Worker Route. Employers must hold an A-rating to issue new Certificates of Sponsorship. Confirm this status before applying to avoid delays or denials.

Certificate of Sponsorship:

To apply for a Skilled Worker visa, you need a valid Certificate of Sponsorship (CoS) from your UK employer. The CoS is a digital document detailing the sponsored role, including job title, type, employment dates, gross salary, sponsor licence number, and expiration date. It provides essential information for the visa application process.

Eligible Occupation:

UK Visas and Immigration will approve a Skilled Worker visa only for positions listed under eligible occupations. Ensure you have the required skills or experience for the role. You may need to request the Standard Occupation Code (SOC) from your employer.

Skill Level Requirement:

Applicants must have skills equivalent to RQF level 3, similar to the UK A-level standard. This requirement emphasizes demonstrating skills rather than holding a specific qualification, allowing for a more inclusive evaluation.

Minimum Salary Requirements:

The Skilled Worker visa initially required a minimum salary of £25,600 per year or £10.10 per hour. As of April 12, 2023, this has been updated to £26,200. Exceptions exist based on occupation-specific “going rates.” If your role has a higher “going rate,” your salary must meet or exceed that amount. Exceptions to the minimum salary requirement allow for eligibility with lower salaries in certain cases.

Financial Capability:

Provide evidence of having at least £1,270 in your bank account for your first month in the UK. Alternatively, your employer can provide a letter confirming their commitment to cover this financial obligation.

English Language Proficiency:

Demonstrate English proficiency through one of the following:

  1. English Language Test: Pass a CEFR English test at minimum level B1.
  2. Academic Qualifications: Hold a degree or other qualification taught in English.
  3. Exemption: Be from an exempt country such as the USA, Canada, or Australia.
  4. Professional Body Approval: Complete an English Language assessment endorsed by a regulated professional body in your field.

Required Documents for the UK Skilled Worker Visa

Documents Needed:

  1. Passport: Ensure it is valid with at least one blank page for visa stamps.
  2. Certificate of Sponsorship (CoS) Reference Number: Include the unique reference number from your CoS.
  3. Job Details: Specify your job title, annual salary, and occupation code.
  4. Employer Information: Provide your employer’s name and sponsor licence number.
  5. Financial Proof: Submit evidence of personal savings.
  6. Family Relationship Proof: Include marriage and birth certificates, if applicable.
  7. Criminal Record Certificate: Required for jobs involving vulnerable individuals.
  8. English Language Proficiency Proof: Submit approved language test results.
  9. TB Test Results: Include if required.
  10. UK PhD Certificate or Ecctis Reference: Provide if applicable.

You must also prove your identity and provide biometrics for your Biometric Residence Permit (BRP) through a visa application center or the Home Office’s ‘UK Immigration: ID Check’ app.

Application Process for a UK Skilled Worker Visa

How to Apply:

  1. Check Your Eligibility: Ensure you meet the Home Office’s criteria.
  2. Secure a Job Offer: Obtain a valid job offer from a licensed UK sponsor.
  3. Receive Your Certificate of Sponsorship: Your employer will provide this key document.
  4. Prepare Necessary Documents: Gather all required documents.
  5. Complete the Online Application Form: Access the form on the Home Office website.
  6. Pay Fees: Pay the application fee, biometric fee, and healthcare surcharge.
  7. Upload Required Documents: Submit all necessary documents electronically.
  8. Arrange a Biometric Appointment: Schedule a biometric session for fingerprint and photo capture.

If applying from outside the UK, expect a decision within three weeks.

Changing Employers on a Skilled Worker Visa

Changing Employers:

  1. New Application Required: Apply for a new visa if you switch employers or occupations.
  2. Timing: Submit your application up to 3 months before starting your new role.
  3. Early Application: Apply early, as decisions can take up to 8 weeks.
  4. Commencement of Work: Do not start working for the new employer until your application is approved.

Extension Process:

  1. Same Employer and Role: Extend your visa if staying with the same sponsor and role.
  2. New Application Needed for Changes: Apply for a new visa if changing jobs or employers.
  3. No Limit on Extensions: Multiple extensions are allowed.

Transitioning from Skilled Worker Visa to Indefinite Leave to Remain (ILR)

Pathway to ILR:

  1. Five Years Residency: Apply for ILR after five years on a Skilled Worker Visa.
  2. Continuous Residence: Ensure you haven’t spent more than 180 days outside the UK in any of the five years.
  3. Life in the UK Test: Complete the test if aged 18 to 65.
  4. Employment and Salary Requirements: Continue to meet these criteria.
  5. English Proficiency: Maintain adequate English proficiency.
